Please read these Terms of Service ("Terms") carefully before using the Services offered by JSimon Holdings LLC, a Florida limited liability company ("Company," "we," "us," or "our"), operating under the trade name HiroResume. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and the Company.

By accessing or using our website at hiroresume.com and all related services, applications, tools, and features (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, you must not access or use our Services.

1. Eligibility

You must be at least 16 years of age to use our Services. By using our Services, you represent that you are at least 16 years old, have the legal capacity to enter into these Terms, and that your use does not violate any law. If using on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Services

HiroResume provides AI-powered resume analysis, scoring, optimization, and document generation services, including:

Free ATS compatibility scoring and analysis of uploaded resumes.
Generation of ATS-optimized resumes based on your information and job listing data.
Generation of cover letters tailored to specific job listings.
LinkedIn profile bio and headline optimization.
Interview preparation guides with role-specific questions and answers.
Salary negotiation guidance.
ATS score comparison reports.

All AI-generated content is provided as a starting point and should be reviewed by you before submission to any employer or third party.

3. Accounts, Purchases, and Payments

3.1 Free Services

Certain features, including the ATS score tool, are free. We may modify, limit, or discontinue free features at any time without notice.

3.2 Paid Services

Starter Package ($29): ATS-optimized resume PDF with one professional template and keyword optimization.
Pro Package ($49): Everything in Starter plus a custom cover letter, three template options, and before/after ATS score comparison.
Premium Package ($79): Everything in Pro plus LinkedIn optimization, interview prep guide, salary negotiation guide, and ATS score report.
Add-On Cover Letter ($19): Additional job-specific cover letter available as a post-purchase add-on.

3.3 Payment Terms

All payments are processed through Stripe, Inc. Prices are in US dollars. You are responsible for any applicable taxes. Payments are one-time charges; we do not offer subscription billing unless expressly stated.

3.4 Delivery

Upon successful payment, documents are delivered to the email you provide, typically within 60 seconds to 5 minutes. If you don't receive them within 30 minutes, contact support@hiroresume.com.

4. Refund Policy

Due to the digital nature of our Services and immediate delivery, all sales are generally final. We may issue refunds at our discretion for:

Technical Failure: Our system fails to generate or deliver due to an error on our end.
Duplicate Charges: You're charged more than once for the same order.
Material Defect: Generated documents are materially defective and we cannot correct the issue within a reasonable timeframe.

Submit refund requests within 14 days of purchase to support@hiroresume.com with your order number. We respond within 5 business days. Dissatisfaction with AI-generated style, phrasing, or design is not grounds for a refund.

5. Intellectual Property

5.1 Our Intellectual Property

All content, features, functionality, software, code, designs, text, graphics, logos, trademarks, and other intellectual property displayed on or through our Services ("Company IP") are owned by or licensed to JSimon Holdings LLC. You may not copy, modify, distribute, sell, lease, or create derivative works without prior written consent.

5.2 Your Content

You retain full ownership of all content you upload or input ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to use, process, and transmit Your Content solely to provide our Services. This license terminates when the data is deleted.

5.3 Generated Documents

Upon payment and delivery, you receive a non-exclusive, perpetual, worldwide license to use, modify, reproduce, and distribute the documents generated for you ("Generated Documents") for any lawful personal or professional purpose. We retain no ownership rights after delivery.

6. User Conduct and Prohibited Uses

You agree not to use our Services to:

Upload unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene, or otherwise objectionable content.
Impersonate any person or entity, or falsely represent affiliation.
Infringe upon the intellectual property rights of any third party.
Transmit malicious code, viruses, worms, or other harmful software.
Attempt unauthorized access to our systems, servers, or networks.
Use Services for any commercial purpose not expressly permitted, including reselling generated documents.
Use automated systems, bots, or scrapers without prior written consent.
Interfere with or disrupt the integrity or performance of our Services.
Create documents containing false, misleading, or fraudulent qualifications.
Use Services in any manner that could subject the Company to liability or reputational harm.

We may suspend or terminate access immediately and without notice for violations.

7. Artificial Intelligence Disclaimer

OUR SERVICES USE AI AND MACHINE LEARNING. YOU ACKNOWLEDGE THAT:

AI-generated content may contain errors, inaccuracies, or omissions. You are solely responsible for reviewing all generated documents.
AI-generated ATS scores are estimates and may not reflect any particular employer's ATS system.
We do not guarantee interviews, job offers, or employment.
Results may vary based on inputs and factors beyond our control.
Our AI may not account for industry-specific nuances or individual employer requirements.

Treat all generated documents as drafts requiring your review and approval before submission.

8. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND WARRANTIES THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JSIMON HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR EMPLOYMENT OPPORTUNITIES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless JSimon Holdings LLC from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of our Services; (b) violation of these Terms; (c) violation of any law; (d) violation of third-party rights; (e) content you submit; or (f) use of generated documents by you or anyone who obtains them through you.

11. Dispute Resolution and Arbitration

11.1 Informal Resolution

Before any formal proceeding, contact support@hiroresume.com. We will attempt to resolve within 30 days.

11.2 Binding Arbitration

Disputes shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in Broward County, Florida.

11.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

11.4 Exceptions

Either party may seek injunctive or equitable relief in court to prevent infringement of intellectual property rights.

11.5 Small Claims Court

Either party may bring an individual action in small claims court for qualifying disputes.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida. To the extent litigation is permitted, you consent to the exclusive jurisdiction of state and federal courts in Broward County, Florida.

13. Modifications to Terms

We may modify these Terms at any time. Material changes will be posted with a new "Last Updated" date. Continued use constitutes acceptance.

14. Termination

We may suspend or terminate your access at any time, with or without cause or notice. Sections 5, 7, 8, 9, 10, 11, 12, and 15 survive termination.

15. General Provisions

15.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement and supersede all prior communications.

15.2 Severability

If any provision is invalid, it shall be modified to the minimum extent necessary and the remaining provisions continue in full force.

15.3 Waiver

Failure to enforce any right is not a waiver. Waivers must be in writing and signed by an authorized representative.

15.4 Assignment

You may not assign your rights or obligations without our prior written consent. We may assign without restriction.

15.5 Force Majeure

We are not liable for delays or failures from causes outside our reasonable control, including acts of God, pandemics, war, government actions, power failures, or third-party provider failures.

15.6 Notices

All notices to JSimon Holdings LLC must be sent to support@hiroresume.com.
